Module Description: The module deals with litigation proceedings in civil and commercial matters under UAE law along with comparisons with such procedures under English law. It discusses the structure of the courts, the steps of filing a lawsuit, the proceedings before each court, and the drafting and issuance of judgments. The module covers topics including sources of civil proceedings, relation to other laws, scope of application & court structure); Judicial jurisdiction; theory of lawsuit; Attendance and absence of litigants; Counterclaims, formal and substantive defences; joinder, suspension and interruption of proceedings; appeal to the higher courts and other methods of challenge; drafting and issuance of judgments; orders on petitions and orders of payment.
The module coordinator will provide students with mandatory texts on UAE Law, prepared purposefully for this particular module.
