Module Description: This module covers the personal guarantee, formal mortgage, usufructuary mortgage and the contractual & statutory priorities of creditors. The module covers topics including: simple / formal mortgage; formation of the formal mortgage; priority of creditors / mortgagees; rights and duties of the parties of the usufructuary mortgage; mortgage foreclosure; legal/statutory priority of creditors; personal guarantee; rights and duties of the personal guarantee parties, and termination of the personal guarantee. It is intended to explain and discuss the relevant main topics under both English law and UAE law.
The module coordinator will provide students with mandatory texts on UAE Law prepared purposefully for this particular module.
